TERMS AND CONDITIONS OF HIRE
Site: The Company’s Quotation assumes the site is:
a) Level and firm ground with easy access for the personnel and equipment.
b) There are no underground drains, pipes, cables and other hidden services on the site selected. Unless previously indicated, <insert company name> cannot be responsible for damage to such items.
a) Similarly, the company cannot be responsible for any damage to the grass or site on which the marquee is pitched.
It is the responsibility of the Hirer to meet our staff on arrival at the site, alternatively, to mark the ground or send a detailed plan or drawing beforehand. (A charge would be made for waiting time).
No guarantee can be given that the equipment will be removed the following day. We will do our best to meet the wishes of our clients whenever possible. Special requirements or changing of planning must be forwarded in writing to info@riviera-marquee-rentals.com 2 weeks prior to the installation date,
Weather Conditions:
The side walls may be removed for the function but it is essential these are replaced afterwards and the doors closed to protect the marquee against damage by winds concentrating under the roof.
Permits:
The Hirer is responsible for obtaining any necessary permits for the erection of <insert company name> equipment on the site, including those required by <insert company name> staff to obtain access to the site. If a permit is required then a copy of the permit confirmation is required.
Loss Damage or Theft:
The Hirer is wholly responsible for any loss or damage to the equipment whilst on site or otherwise in the possession of or under the control of the Hirer arising out of any cause outside of the direct control of the Company and/or its employees and in the event of any loss or damage however caused agrees to indemnify the Company for the full cost of any repair or replacement of the equipment.
No decorative tinsel, crepe paper or self adhesive material to be affixed to the Marquees without prior arrangement.
Inventory
On the delivery date it is required that the hiring completes and signs and inventory to guarantee all items delivered and that all items are in full working order. Any items that may be seen to be damaged after the inventory RMR must be informed maximum 4 Hours after inventory signature.
Insurance
Prior to the Installation of the Marquee, or any delivery of items supplied by RMR a valid Liability Insurance Document must be produced. Failure to supply invalid Insurance documents will result in criminal action.
Damage Waiver:
<insert company name> can arrange a damage waiver on your behalf at 5% of the hire fee (min 1.500.00€ of hire charge).
Payment Details
On acceptance of the Contract 50% of the total amount will be required to secure the items this is non refundable on cancellation of the Order.
The balance is required prior to or on site at the time the Marquee is installed.
Tva is calculated at 19.6% of the HT Price.
RMR Accept Visa 1.5%charge Amex 2.95% charge, Bank Transfers 0 charge, French Bank Cheques only, certified with 2 proof of identity. Cash is acceptable.
Please note payment made by cheques must be paid 2 weeks prior to the installation
Caution Payment
A caution payment will be required which is refundable on the Final inspection this will be a certified French cheque, or Credit Card, or Cash this is to cover any initial damage during the Rental.
It is the duty of the Hirer to inform RMR of any damage that they are aware of during the Rental.
Rentals under 5.000.00€ = Caution 1.000.00€
Rentals 5.000.00€ - 15.000.00€ = Caution 2.000.00€
Rentals 15.000.00€ - 30.000.00€ = Caution 4.000.00€
Rentals 30.000.00€ plus = Caution 6.000.00€
Cancellation or Premature Termination of Contracts:
In the event of the Hirer desiring to cancel the contact after a firm order has been placed, if the cancellation date is 14 days or more prior to the delivery date, there will be a charge of 20% of the remaining balance due; if the cancellation 3-13 days prior to the delivery date, the charge will be 30% of the remaining balance due and if the cancellation is less than 3 days prior to the delivery date, the full charges are due. Failure to complete the payments necessary will result in criminal action.
Force Majeure:
While every effort will be made by the Company to carry out any order accepted, the full performance of it is subject to variation or cancellation by the Company consequent on any event outside the direct control of the Company or its employees.
All the terms and conditions are outlined above to protect RMR and the Hirer, Both parties are in agreement with all the above items
